Terms of Service

By accessing or using My Sales Guru ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Creo Holdings LLC ("Company," "we," "us," or "our").

My Sales Guru is a subscription-based sales productivity platform designed for individual sales professionals. The Service includes:

• Video Message: AI-assisted video recording and delivery via SMS and email
• Live Sales Coach: Real-time coaching scripts and closing tools during sales conversations (Closer tier only)
• Goal Tracking: Monthly goal setting and daily activity planning
• Contact Management: Personal CRM for managing customer relationships

Basic Plan — $35/month: Includes Video Message, goal tracking, and contact management.

Closer Plan — $55/month: Includes all Basic features plus the Live Sales Coach, personalized closing scripts, and social marketing tools.

Subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are in USD and are non-refundable except as required by law or as described in Section 4.

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

You may cancel your subscription at any time through the Billing section of your Settings page. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the period you have paid for.

We do not offer prorated refunds for partial months. If you believe you were charged in error, contact [email protected] within 30 days of the charge.

You agree to use the Service only for lawful purposes. You may not use the Service to:

• Send unsolicited commercial messages (spam) to individuals who have not consented to receive them
• Violate the Telephone Consumer Protection Act (TCPA) or any applicable state telemarketing laws
• Harass, threaten, or deceive any person
• Transmit false, misleading, or fraudulent content
• Impersonate any person or entity
• Reverse engineer, copy, or create derivative works of the platform
• Use the Service in any way that violates applicable laws or regulations

You are solely responsible for all content you create, send, or transmit through the Service, including video recordings and messages sent to your customers.

By using Video Message to send messages to your customers, you represent and warrant that:

• You have obtained all necessary consents required under the TCPA, CAN-SPAM Act, and applicable state laws
• You will include opt-out instructions in all commercial messages
• You will honor opt-out requests promptly
• The recipient has an existing business relationship with you or has expressly consented to receive messages

We reserve the right to suspend or terminate your account if we receive complaints about messages you send through the platform.

Your contacts, video recordings, and goals belong to you. My Sales Guru is designed to be salesperson-portable — your data is tied to your individual account, not to any dealership or employer. You may export your contact data at any time from the Contacts page.

Upon account termination, you may request a data export within 30 days. After 30 days, your data may be permanently deleted.

The My Sales Guru platform, including its software, design, and AI models, is owned by Creo Holdings LLC and protected by intellectual property laws. You retain ownership of the content you create (videos, scripts, contact data). You grant us a limited license to process and store your content solely to provide the Service.

The Service uses artificial intelligence to generate sales scripts, coaching suggestions, and daily plans. AI-generated content is provided as a starting point and may not always be accurate, appropriate, or suitable for your specific situation. You are responsible for reviewing and approving all AI-generated content before using it with customers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL RESULT IN INCREASED SALES OR INCOME.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREO HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST SALES, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Creo Holdings LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Bernalillo County, New Mexico.

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance.
